Writ Petition (L) No. 2626 of 2011 Order dated 31/1/2012

Sir,

With reference to the above mentioned writ petition (L) No. 2626 0f 2011 and order dated 31/1/2012 in which the Hon’ble High Court of Bombay was pleased to direct all of you to decide the duplicate permit /renewal / replacement order and compounding fee refund applications of all the applicants will be decided within three months from the date of above said order. 

As you aware that, you all are harassing / threatening the applicants’ one and the other reasons, best known to you. It is pertinent to note that no RTO / your office is maintaining any file related to the permit holders except the permit register.  It is pertinent to note that most of the applicant had filed their grievances / applications for the issuance of duplicate permit since 2008 but now after 4 years you are claiming that no papers / applications are found in your office. 

You all are harassing the permit holders on the name of MMRTA meeting and also calling the applicants every day in the office and after waiting hours they left without any proper reply from your office or your officers are sending the applicants from one desk to another.  Now the RTOs are threatening the applicants if they insist to refund the compounding fee then their permit will be cancelled. 

As you aware that from the conduct of you and your officers that they are willfully and deliberately violated the order of the Hon’ble High Court of Bombay and we had already filed Contempt Petition before the Hon’ble High Court of Bombay.

It is pertinent to not e that your offices are well aware of that  the copies of the original receipt of compounding fee, permit and replacement orders etc.. are in the custody of fleet taxi companies and if you need then why your offices are not ready to issue the notice to them also to cross check the original papers.  

We call all of you to please clear your position / stand that why you and your officers are harassing the applicants willfully and deliberately and also threatening as mentioned above.  We also request you to please let us know why your offices are failed to pass the speaking order case by case with reason as per the order of the Hon’ble High Court of Bombay in the writ petition mentioned above.

From the above mentioned facts and circumstances, we request you to please clear your position within one week from the receipt of this letter, failing which we have no option but to approach the Hon’ble High Court of Bombay as per the law entirely at your risk and cost, which please note.

We again request you not to harass and threat the applicants in future.
