General Meeting & Election of the Union.
Sir,
We would like to draw your attention that the undersigned are the
life time members of the Mumbai Taximen Union.
We would also like to draw your attention that since 1960 there is
no free and fair election in the union.
All the office bearers are holding the position including you for the
last few decades. It is pertinent to
note that the office bearers of the Mumbai Taximen Union had amended the
constitution for their own motive but not ready to amend the coram of the
annual general meeting as per the current membership.
It is further pertinent to note that you always called only
300-400 members in the annual general meeting had taken the signature on the
minutes of the meeting before entering the venue of the meeting and thereafter declare
as elected office bearers unopposed or without free and fair election.
As you are aware that union has about 40,000 members and need a coram
of 3/2rd of members but union is playing with members and on the basis of 1000
members you are gathering only 300 to 400 members as mentioned in the
constitution since 1960.
It is pertinent to note that every year the annual general meeting
was called but when one member Mr. Shiv Adhar Yadav wanted to contest the
election in the year 2007-2008 at that time you had also used the illegal
tactics for election and declared yourself as the General Secretary of the
union.
It is further pertinent to note that you had amended the
constitution of the union and instead of every year you amended in the
constitution of the union that election will be held after 3 years.
Under the above mentioned facts and circumstances, it is crystal
clear that office bearer of Mumbai Taximen Union had adopted undemocratic
process in the union. Hence, we request
you to please let us know when you are going to call the annual general meeting
and election date with the name of the election officer within 72 hours from
the receipt of this letter, failing which we have no option but to approach the
Hon’ble High Court of Bombay in the way of writ petition entirely at your risk
and cost, which please note.
