With reference to my letter/notice dated 28/04/2012, to call the Annual General Meeting and election of the office bearer and Managing Committee of the Union.

It is pertinent to note that you are not adopted the democratic process to hold the Annual General meeting and election of the office bearer and managing committee of the Union since decades.

It is pertinent to note that you had elected yourself for the two posts i.e. General Secretary and Treasurer of the Union during 1999 to 2007 and in the year 2008 you had the election officer and the contestant for the post of General Secretary.

It is further pertinent to note that whoever or any member of the union raised   illegal act of yourself and the corrupt practice of the office bearers or any member wants any information from the union in writing then you always issued notice/memo on the false allegations that he is indulged in the anti-union activities and thereafter the member is expelled from the union.

Now most of the members are fed up and not ready to accept your dictatorship or illegal acts anymore. Hence we all 340 members have decided to send the above mentioned notice to you and the president to call the Annual General Meeting as per the constitution of the union within 20 days from the receipt of our above mentioned notice, failing which we have no option but to call the AGM and conduct the election of the office bearer and managing committee of the Union without giving any further notice and the decision of the AGM is bound upon all of you or the union or its members.

It is pertinent to note that members have the right to send the notice to you or the union to call such AGM and conduct the election of the office bearer and managing committee of the Union.

I/ We again request you to please furnish the copy of the list of members along with their address and contact numbers and also let us know when you are going to call the AGM. You also furnish the agenda of the meeting along with the name of the election officer with the nomination form to contest the election of the office bearer and the managing committee or otherwise we are going to call the same AGM as per our notice dated 28/04/2012 without any further intimation to you.

You had sent the reply of my said letter/notice on dated 07-05-2012, which I received on 08/05/2012 and you are seeking the original signature of all the 340 members. I am sending the same as certified true copy of the signatures attested by the notary and the original is kept with us and you are free to inspect the same between 9 am to 5 pm Monday to Friday after giving advance notice in writing to me.

I/We are also sending you the certified true copy of the signatures attested by the notary of more _________members, who are also with us to call the Annual General Meeting and election of the office bearer and Managing Committee of the Union.

I/We again request you to please clear the following assets that the same are the property/ assets of the union or your personal assets.

1.     Taximen’s Services Ltd.   

2.     Taximen’s Enterprises

3.     Taximen’s Finance and Lease Ltd.

4.     Airport Taximen’s  Welfare Trust

5.     Taximen’s  Welfare Society

You should also declare other assets of the union and also declare the assets of the office bearer and the Managing Committee members.

You should also clear your or union position that under what law and authority you had hypothecated the taxi vehicles of the members of the union when there is no such provision in the constitution of the union.

You should also clear your position that under what law or authority you stop to enroll the new members or renew the membership of the union?

I/We also request you to please furnish the permanent address of our President Mr. George Fernandez, because he has not visited Mumbai since long and also let us know who had signed the election forms of our president.

On the above mentioned facts and circumstances it clearly establishes that now the members have no faith in the present Managing Committee and the office bearers.

 Hence the AGM and the fresh, free and impartial election of the office bearers and the Managing Committee as per the provisions of the constitution of the union and as per due procedure of law should be conducted in the interest of all the members and the union.
