Subject: Annual General Meeting, agenda of the AGM and free and fair election of the office bearers and Managing Committee.

Reference: Your letter dated 16/5/2012.

Dear Sir,

With reference to your above mentioned letter dated 16/5/2012 in response to my notice/letter dated 28/4/2012 and 10/5/2012. 

I am not shocked and surprised to see the content of your reply because it is your corrupt practice to vague reply on other issues and avoiding replying our main issues.  It is pertinent to note that in the year 2008, one union member Mr. Shiv Adhar Yadav had also demanded the same issue raised by me and other taximen / members but after adopting the corrupt practices you had expel him from the union. 

You are very well aware that your election since 1993 till date is illegal and all the amendments made in the union constitutions are null and void because since 1993 up to 2007 you declared elected on two positions of the office bearers i.e. the General Secretary and Treasurer so that you should get the right to sign the cheque   and manipulate the accounts according to your whim and wish.  It is against the law.

It is further pertinent to note that in the year 2008, you become the election officer and also the contestant for the post of General Secretary which is also against the law. 

It is further pertinent to note that myself and other union members wanted to know about the assets of the union and the companies mentioned below :-

1.     Taximen Services Limited
2.      Taximen Enterprises
3.     Taximen Finance and Lease Limited
4.     Taximen welfare Society Limited
5.     Airport Taximen Welfare Trust & others

If you and your conscious are clear then clear your position that above 5 companies / trust / societies are the property of the union or your personal family companies etc.

If you are the well wisher of the taximen and the union then declare your assets because you are the leader of the union since three decades.

Instead of giving any reply about the above mentioned issues you had suspended end number of union members and stop to renew the membership of the existing members and also stop enrolling new members for your personal motives and gain.

I would also like to draw your attention that our founder president Mr. George Fernandes is not well and he has not visited Mumbai since long.  I             would further like to say that Mr. George Fernandes has not attending any AGM or participating in any office bearers election for the  position of the president of the union since decades and no question arise that he has signed any nomination papers till date.  It is true that Mr. George Fernandes elected as a member of Rajya Sabha in July 2009 but every union member including you also know he has not attending any AGM or contesting the election for the last few decades. We put you on strict documentary proof and if you have then furnish the same to me under the intimation to the registrar of trade union office.

Para No. 1: No need to reply

Para No. 2: Your all the allegations and claims are baseless and far away from the fact.  You are intentionally using the delay tactics to reply/date about the forthcoming AGM and the election. I sent the true copy of the signatures of the members and you and your people indulged and approached some of the members and by force you had taken the signature on one draft letter and they are not aware that what you had written in English language and also busy to create rumors after distributing the handbills in which you claim that all the demands and the allegations are illegal and no support of the bye-law of the union but you are not ready to declare the date and venue of the forthcoming AGM and election till date.  It is pertinent to note that you are giving a reply on the allegations on you under the shelter of illiterate poor taximen.  It proves that how you are playing with the taximen and taxi trade since decades for your own motives and gains.

Para No. 3: I am very much aware about the AGM dated 30/8/2008 and also aware that how you and your own hundreds of people conduct the AGM and the election.  It is pertinent to note that you had amended the constitution for your own motives but I had already explained about how your AGM and election in 2008 was illegal and there is no question that those amendments are lawful.

It is further pertinent to note that now you claim the union has only 26000 members but earlier our union had around 40,000 members.  I say that when the AGM and the election required only 300 to 400 members and you had amended the bye-laws of the union that 1/5th members of the union has right to call the AGM  then why you have not amended the corum to elect and amendment in the bye-laws of the union.

Para No. 4: in regard to our founder President Mr. George Fernandes’s visit to Mumbai and filing or sign any nomination papers to contest the election for the position of the president.  It is pertinent to not that I had already explained in the Para mentioned which is self explanatory.  It is further pertinent to note that you and your associates particularly your relative Mr. Fedric D’sa are misusing and exploiting the name of our founder president Mr. George Fernandes for your personal motive.    

Hence, I again request you to please clear your position on the issues raised by me and other union members without any further delay and also let us know the date of the AGM and the venue if you are going to call the AGM, within one week from the receipt of this letter / reply failing which I / we have no option but to call the AGM through public notice in the newspaper which please note. 

Your all the replies / actions are vague and against the law and not maintainable in any court of law, which also please note.
