Illegal Acts by Mr. A.L. Quodros, General Secretary of MTU

Subject: Illegal Acts by Mr. A.L. Quodros, General Secretary, & the Free and fair forthcoming election of Mumbai Taximen Union

Sir,

We would again like to draw your attention about the Illegal Acts by Mr. A.L. Quodros, General Secretary Mumbai Taximen Union. He is the General Secretary of the Mumbai Taximen Union for the last about 25 years.

We say that he was holding two positions i.e. General Secretary and the treasurer of the union for Nine years i.e since 1999 to 2007 and one taximen Shivadhar Yadav had filed complaint with your office but till date no action has been taken by your office the reason best known to you. The copy of the said complaint and the returns filed by Mr. Quodros with your office in which clearly established that he was holding two positions in the union. It is pertinent to note that in the Union Constitution it is very much clear that the General Secretary or the treasurer had the right to sign the cheque.

We say that Mumbai Taximen Union is indulging in finance business and they got the Trade Certificate for the hypothecation from the Regional Transport Office, Mumbai Central and end no. of taxi vehicles were hypothecated on the name of the Mumbai Taximen Union which is against the provision of the constitution of the Union. Copy of the said Trade Certificate is annexed for your ready reference. It is pertinent to note that the General Secretary of the Union admitted of giving loan to the taximen in reply filed in the Hon’ble High Court of Bombay in Writ Petition no 2237 of 2008.

We say that on the earlier election conducted on 31/08/2008 Mr. Quodros was the election officer and the contestant for the post of the General Secretary which is also against the provision of the law. The said General Secretary Mr. Quodros had circulated the agenda of the AGM of the union on 16/08/2008 in the way of hand bill in which clearly mentioned that he was acting as election officer and he himself contesting the election as the candidate for the post of General Secretary also, which is against the democratic process of law.

We say that end no. of member of the Mumbai Taximen Union want to know about the companies/assets of the Mumbai Taximen Union as under:

a)   Taximen services Limited
b)   Taximen Enterprises
c)    Taximen Finance and Leasing  Limited
d)   Airport Taximen Welfare Trust
e)   Taximen Welfare Society

We say that A.L. Quodros is acting as dictator with his own people i.e. Fredric Disa, Birappa Naik and on the name of George Fernandez of the Mumbai Taximen Union. It is pertinent to note that now end no. of members of the union are demanding the free and fair election of the union by democratic process i.e. by ballet. It is pertinent to note that Mr. George Fernandez is on bed for the last so many years and never visit Mumbai and how and who had signed the election form of Mr. George Fernandez to contest the election?

We say that the members of the union are demanding list of the members along with their complete mailing address with contact nos., name of the election officer, application form for the contestants and other information including the agenda of the forthcoming AGM with date but instead of furnishing above mentioned information to the members, Mr. Quodros issuing false and fabricated show cause notice to them and making false allegation that they are indulge in anti union activities and try to expel from the union. It is pertinent to note that Mr. Quodros did the same act in the 2008 when Mr. Shivadhar Yadav demanded their free and fair election.

We say that now the Union has stop to enroll the new members and Mr. Quodros is enrolling his own persons as member of the union, which is illegal and sabotage the election of the Union. 

Under the above mentioned facts and circumstances, we request you to please take immediate necessary steps to conduct the free and fair election of the Mumbai Taximen Union in the democratic manner and direct them to furnish the above mentioned information to the members within a next one week from the receipt of this notice or letter, failing which we have no option but to approach the in the way of Writ Petition 226 of the Constitution of India at your risk and cost, which you please note.
