PUBLIC INTEREST LITIGATION NOTICE ON PARKING ISSUE IN MUMBAI

Subject: Unauthorized commercial vehicles parking stands and illegal parking under the Metro Line Bridge, in and around Domestic and International Airports and in the jurisdiction of  MIDC, Sahar, Airport, Vile Parle, Andheri, Sakinaka and Jogeshwari Police Stations & unauthorized parking stands under the banners/flags of Political Parties.

 Sir,

We would like to inform you that the traffic of the whole Mumbai city is become worst and everywhere unauthorized vehicles are parked in the NON PARKING area & the commercial vehicles are indulged for the encroachment under the banner/flag of the political parties, trade Unions. It is pertinent to note that even our taximen/automen are  also put their private taxi stands in the no parking areas or the corner of the roads/crossings, one way roads, single roads, etc but due to the non action of your officers, know the situation are worst.  

We would like to draw your attention that the parking mafia is busy in the encroachment on roads under the protection of the local police station and the traffic police division officials willfully and deliberately. They are creating traffic jams/problems and also law and order problems in the area. You’re all the officers working in the respected area are indulge in corruption and providing help this parking mafia and not ready to take any action against them.

The parking mafia is parking their vehicles both the sides of the roads, corners, western express highways, under the Metro Line Bridge from Versova to Ghatkopar, in and around Domestic and International Airports and in the jurisdiction of MIDC, Sahar, Airport, Vile Parle, Andheri and Jogeshwari Police Stations.

When we approached your concerned officers/traffic head constable/beat marshals then we got shocking reply that “where the people park their vehicle?” and they told us this is the duty of the Commissioner of Police and Joint Commissioner of Police, Traffic. We feel shame if your officers reply in such manners.

We would also like to draw your attention that the Vile Parle Police Station is not ready to take any action against the tourist/meter taxi/fleet taxi and other vehicles parked outside/in and around the Police Station on the one way road, western express highway under their jurisdiction. All the times there is a traffic jam but they are not ready to do anything for their personal gain.

In the similar manner MIDC police station knows about the vehicles parked on the heavy traffic roads 24X7 but they don’t bothers. If you have some time then visit in those areas & then you known the reality about the same and also know how your officers are indulged in corruption.

It is pertinent to note that parking under the Metro line are security threats to our Metro Rail projects & you know very well this facts. It is pertinent to note that in the Sakinaka Area, Motor Garages & tourist cabs has encroached permanently under the Metro line and traffic is the major problem in this area.

It is pertinent to note the commercial vehicles are indulged for the encroachment under the banner/flag of the political parties, trade Unions. It is pertinent to note that even our taximen is also put their private taxi stands in the no parking areas or the corner of the roads/crossings, one way roads, single roads, etc but due to the non action of your officers, know the situation are worst in the city of Mumbai.  

The different agencies i.e., BMC, MMRDA, Mumbai Police & the Traffic Police are putting the blames on each other’s for the illegal parking stands & the parking in the non parking areas.

We request both of you to please direct your concerned officers to take immediate necessary action on the above mentioned matter & clear the roads for the Public at large within two weeks, failing which, we have no option but to approached the Hon’ble High Court of Bombay in the way of “PUBLIC INTREST LITIGATION” entirely at your risk & cost, which you please note.

Holding Area for the Black & Yellow, Cool cab and Mumbai Pune Meter Taxi at the Domestic Airport

Subject: Holding Area for the Black & Yellow, Cool cab and Mumbai Pune Meter Taxi at the Domestic Airport

We would like to draw your attention about the un necessarily conflict between the taxi trade union of cool cab and black & yellow. This conflict now gets the communal color at the airport area. It is pertinent to note that both the groups had created the two worship places in the parking areas i.e. one group is holding Aarti and other is holding Namaz, which is very dangerous to the civil society as well as the security threats to our airports.

We came to know that your office/MIAL is going to allot the holding area for the black & yellow, cool cab and Mumbai Pune meter taxi above the basement parking in front of the terminal 1-A at the Domestic Airport. We would like to share our views as under:

1.     If your office is going to allot the holding area for the above mentioned taxi services then your office should provide a one shelter or sitting arrangement so that they (black & yellow and cool cab) can sit together and spent time with each other. It is pertinent to note that only few so called leaders are dividing these drivers on the name of religion for their own interest.

2.     In the similar manner, your office should provide water and other utility services for all the taxi drivers not for the groups.

3.     If your office is success to implement the above mentioned two points than half of the problems face by your office as well as us are going to solve automatically.

We would also like to draw your attention that after the said holding area allotted to the above mentioned meter taxi service providers then the major task that your office should not allowed any of the such taxi parked in the airport area or even near the Balaji restaurant, roads, terminals, near the post office, near the basement parking, near the petrol pump and other areas.

If you want then you may gave strict instructions to your private security company and the towing Crain to tow such vehicle immediately, when they found in the no parking area.

 Your office may issue warnings in writing to such miscreants’ all taxi drivers including fleet taxis, phone fleet taxis and tourist cabs. If even then they are not ready to obey the standing instruction or obey the traffic rules then the entries of such taxis may be ban in airport area.

We would again like to draw your attention that the above mention points are our suggestion only and you may consider the same, if you think that you will get the best results and able to provide the best taxi services to the passengers.

This is our suggestion letter not the direction letter.

Violations of terms & conditions of the Call Taxi Scheme 2010 by the “BOOK MY CABS”

Subject: Violations of terms & conditions of the Call Taxi Scheme 2010 by the “BOOK MY CABS”

Sir,

We would like to draw your attention that your office introduced several schemes for the Taxi Trade as under:
1.       Fleet Taxi Scheme 2006
2.       Call Taxi Scheme 2010
3.       Phone Fleet Taxi Scheme 2010

But your office is always busy to amend in the scheme as per the whim and wish of the beneficiary of the scheme not to the Taximen. You may check your records and found that how your officials issue licenses to any one after violating the conditions of the scheme. It is pertinent to note that till date three existing fleet taxi companies have not fulfilled their conditions but your office is sleeping and willfully & deliberately not ready to take any action against the following fleet operators as under mentioned:

1.       Mega Cabs
2.       Easy Cabs
3.       Meru Cabs

It is pertinent to note that now your office is keep mum on the following companies, who are violating the Motor Vehicle Act and running the meter radio taxi as under:

1.       OLA Cabs
2.       Meru Plus  & many more

In the similar manner, now the BOOK MY CAB had violated the terms of the Call Taxi Scheme 2010 and your offices is keep mum and allow them to exploit the poor taxi men at large under the scheme:

a)      They are taking vehicles under the scheme more then 5 years but condition is only two years old vehicle will join this scheme.
b)      The company is not paying any RTO fee, BMC & other Government taxes on their own publicity on cabs.
c)       The company is charging the cost of the installation of GPS from the taximen under the scheme & also switching the GPS system to Mobile GPS.
d)      The company is charging the 10% share from the fare provided by the company.
e)      The company is not ready to provide any social benefit to the taximen.

We request you once again to conduct the time bound enquiry about the conditions of the scheme and take necessary action against them and protect the interest of the taximen at Large, failing which we have no option to approach the Hon’ble High Court as usual because your non action on any complaint/intimation or violation of any conditions of the scheme.

Subject: Information of the Taximen by the Sahar and Airport Police Station

Dear Sir,

With reference to the above mention subject matter and the security concern of our Airports. We would like to draw your attention that the Sahar and Airport Police Station want to compile or keep the record of the taximen for the security of the passengers as well as the security of the airports.

We will welcome your step and also forward our co-operation to keep the record of the taximen for the security of the passengers as well as the security of the airports. It is pertinent to note that our Mumbai Taximen Sangathan is ready to extend our all efforts to collect the information of the taximen, who ply their taxis from both the airports.

With your due respect, we would like to draw your attention that we are capable to make the information/data of all the taximen in digitalize system and also update on the day to day basis. We will keep the information of the taximen along with their documents. (copy of the said form is annexed with this letter for your ready reference/consideration) it is pertinent to note that this information help to the law enforcement agencies, traffic police, State Transport Department and local police.

We had also design the stickers for the taxi vehicles with our hologram sticker and the same stickers will be given to the taximen who operate from the airports and have the information of the taximen as mentioned/attached form. We will also keep the finger prints, retina print, blood group, photo, family history and other relevant information as mentioned in the attached information form with this letter.

It is pertinent to note that we are capable to issue one identity card, which is next to impossible to make forged or alter. It is further pertinent to note that the shelf life of the said identity card is minimum 25 years and it is weather proof, acid proof, water proof, scratch resistance, fire resistance and many more features.

If the administration is ready to implement the said system for the security of the passengers as well as the security of the airports, then no taximen dare to threat to the passenger or our airports.

We hope you may go through our proposal and if you found suitable and viable then we are ready to give you the presentation for your further consideration, if you are really concerned about the security of our passengers and airport.
