SUBJECT: OPEN LETTER & PROTEST MARCH ON 02/06/2012
AT 12:00, AT KAMGHAR BHAVAN, BANDRA KURLA COMPLEX, BANDRA EAST, MUMBAI.
We, Jaishree
Singh, Uma Shankar Singh, Harinath Dubey, Md. Tauifk Md. Alias & others are
life time members /members of the Mumbai Taximen’s Union want to know the
following questions:
1.
When our member Mr. Shiv Adhar Yadav, demanded the free and fair
election of the union in the democratic manner in the year 2008 along with the entire
list of members of the union with the address and contact numbers as well as
the name of the election officer then why you are failed to furnish the same
but you had expelled him from the union.
Explain to the members of the union?
2.
Now, we are again demanding the same free and fair election of the union in the democratic
manner and agenda of the forthcoming AGM with date and also the entire list of
members of the union with the address then why you are doing the same illegal
act and suspended the members of the union along with your following illegal
acts
a. Why and
under what circumstances / law you are stop enrolling the new members and renew
the membership of the union?
b. Why you and
your people are indulge to take the signature on the white papers and affidavits
instead of giving straight reply of members letter/notice?
c. Under what
law and authority you were holding the two positions of the union since 1993 to
2007 i.e. General Secretary and Treasurer? Hence your election was illegal and
all the amendments of the byelaws of the union during this period are null and
void.
d. In the year
2008 AGM of the union you amended the bye-laws of the union regarding the
tenure of the office bearers of the union from one year to three years and
without the approval from the registrar of trade union you cannot implement the
amendment in any circumstances or law? Hence, your election for a period of
2008 to 2011 is illegal.
e. In the year
2008 election you declared himself as an election officer and you are the contestant
for the post of General Secretary, hence,
your election was illegal. It is pertinent
to note that nothing is mention about the election for the period of 3 years in
the agenda of the AGM in 2008.
f. As per your
handbill you claim that election was held for the period of 3 years in the year
2008 and thereafter in the year of 2011 and next election will be held in the
year 2014. It is pertinent to note that you had not submitted the detail of the
election for the period of 3 years which is held in the year 2011 along with
list of the elected members etc. to the Registrar, Trade Union till date.
3.
We say that, the Office of
the Registrar, Trade Union are indulged with your all illegal acts willfully
and deliberately since decades and not
taking action about your illegal acts till date, for their personal gain.
4.
We say that, you cannot misguide the taximen at large after misusing
the name of our founder President Shri George Fernandez.
5.
We say that, you should
also clear your position that how and under what authority and law your
relative Mr. Fredric D’sa and his manager of Airport Taximen Welfare Trust Mr.
Illahi are representing the union before the State Transport Department/RTOs?
6.
It is further pertinent to note that we and
other union members wanted to know about the assets of the union and the
companies mentioned below :-

Taximen Services Limited
2.
Taximen Enterprises
3.
Taximen Finance and Lease Limited
4.
Taximen welfare Society Limited
5.
Airport Taximen Welfare Trust
& others
If you and your conscious are
clear then clear your position that above 5 companies / trust / societies are
the property of the union or your personal family companies etc.
If you are the well wisher of the
taximen and the union then declare your assets because you are the leader of
the union since three decades.
We challenge
you by this open letter to explain the above mentioned your illegal acts within 48 hours and also
request the Registrar, Trade Union to take
necessary action against the illegal act, failing to take necessary legal
action against you and your associates then we stage / organize protest rally
before the office of the registrar, trade union on Saturday i.e. 2nd
June 2012 between 12 to 2 p.m. in protest of non action by the registrar, trade
union and thereafter we are going to file the writ petition before the Hon’ble
High Court of Bombay entirely at your risk and cost, which please note.
We also warn
you not to organize or conduct any AGM or election till the decision by the
registrar, trade union which also please note.
