Sub: Issuance of duplicate permit, replacement order and refund of compounding fee.

Ref: Writ petition no. 2626 of 2011

Sir,

We would like to draw your attention that your all Regional Transport Offices (Eastern, Western & Central) are not ready to obey the order of the Hon’ble High Court of Bombay in the writ petition no. 2626 of 2011 deliberately and willfully.

We further say that particularly two Dy. RTOs of Central & Western Mr. Jeevan Bansod and Mr. Meshram has the problem to issue the duplicate permit / replacement order and refund of compounding fee.

Now, one of the permit holder Mr. Md. Jaleel Ashique Shaikh had approached Mr. M.R. Patil – ARTO, taxi division, Central Region for the replacement order but he was informed that as per Mr. Jeevan Bansod, Dy. RTO every permit holder has to pay professional tax as well as to give the affidavit that the permit holder is not interested to take the refund of compounding fee in that condition he will able to issue the replacement order to Mr. Md. Jaleel.

It is pertinent to note that Mr. Bansod had succeed  to get such affidavits forcibly from few permit holders and thereafter he had instructed Mr. Patil to issue the replacement order to them.

Under the above mentioned facts and circumstances, it’s crystal clear that your officers are deliberately and willfully not ready to implement the order of Hon’ble High Court of Bombay and indulge in harassing the taximen at large.

As you are aware that, we had already filed the contempt petition in this regard, hence, we request you to please look into the matter personally and warn your officers that not to misuse the power as a public servant.

It is further pertinent to note that we had already intimated to you about the illegal acts of your officers time to time but nothing is happened till date.

Hence, we once again request you to please direct your officers to act as per the order of Hon’ble High Court of Bombay in writ petition no. 2626 of 2011 and confirm.

Thanking you,

Yours faithfully,
For Mumbai Taximen Sangathan
