CONTEMPT OF COURT BY RTO WILFULLY AND DELIBERATELY

Reference: Order in writ petition no. 2626 of 2011
Subject: Non implement of order willfully and deliberately

Sir,

With reference to the above mentioned order in writ petition no. 2626 of 2011 and non implement of order willfully and deliberately by your all the RTOs (Eastern, Western and Central).

In the above mentioned order, the Hon’ble High Court passed order clearly that all the applications/cases will be decided within three months from the date of order and reason will be given in writing case by case.

It is pertinent to note that before filing the above mentioned writ petition no. 2626 of 2011, your office had sent the guidelines to the respective RTOs in connection with the Mumbai Gold Cabs permit matter but sorry to say that your all the RTOs are not ready to act as per the guidelines issued by your office willfully and deliberately.

It is further pertinent to note that your officers had also sent the guidelines/circular no. MVR0904/CR-560/2(4)/Outward No. 14366 dated 26 July 2007 to issue the trade certificate to the money lenders but sorry to say that no RTO has act as per your above mentioned  guidelines/circular till date.  

We say that, your officer particularly RTO Central Mr. Jadhav, Dy. RTO Mr. Jeevan Bansod, Dy. RTO (Western) Mr. Meshram and  RTO Eastern are not ready to issue the replacement order to the applicants who is holding valid permits willfully and deliberately.  It is pertinent to note that they are sending letters to visit them but when the applicant visited there then they are ready to see them and give another date to come.

We say that, your officers are threatening the permit holders if they are not going to give the affidavit with the statement that they are not interested to take the refund of the compounding fee and the Mumbai Taximen Sangathan are pressurizing them to take the refund and also pressurize them to file the contempt of court petition otherwise they are not going to issue the replacement order and going to cancel the permit. 

As you very well aware that, we had already filed the contempt petition before the Hon’ble High Court of Bombay in the above mentioned writ petition no. 2626 of 2011. 

Under the above mentioned facts and circumstances, we request you to please look into the matter personally   and take immediate necessary steps in this matter and inform us the action taken by you if you desire so.
